Terms of Service

1. Acceptance of these terms
These Terms of Service govern your access to and use of WellEstimate.com (the “Service”). By using the Service, you agree to these terms and our Privacy Policy. If you do not agree, do not use the Service.
2. What the Service provides
WellEstimate organizes historical water-well records into maps, summaries and planning context. It may also let you submit project details to request contact about well services. Features, geographic coverage, source data and availability may change.
3. Planning information—not professional advice
The Service is for general educational and preliminary planning purposes. It is not geological, hydrogeological, engineering, environmental, legal, water-quality, construction or other professional advice. It does not replace a site inspection, water test, regulatory review or assessment by a licensed professional.
Historical records may be incomplete, inaccurate, approximately located, outdated or unrepresentative of your property. Conditions can vary over short distances. We do not guarantee well depth, geology, yield, water quality, pump requirements or construction outcome.
4. Prices and cost allowances
Any displayed dollar amount is a broad, non-binding planning allowance—not a quote, offer or guarantee. A displayed range may use nearby recorded depths and general market assumptions, but it cannot account for every property, contractor or project condition.
Contractor pricing and inclusions vary. Access, mobilization, minimum charges, casing, sealing, unsuccessful-hole terms, trenching, electrical work, pumps, controls, testing, treatment, permits, taxes and unexpected conditions may materially affect the final cost. Rely only on a written, site-specific contractor quote.
5. Quote requests and contractors
Submitting a form does not guarantee that a contractor will contact you, accept a project or provide a particular price. WellEstimate is not the contractor performing the work and is not a party to any agreement between you and a contractor.
You are responsible for checking licences, insurance, experience, references, scope, warranties and regulatory compliance before hiring anyone. Unless expressly stated, a listing, introduction or response does not constitute our endorsement or warranty.
6. Your submissions
Information you submit must be accurate and must not violate another person’s rights. You authorize us to use and share submitted project details as described in the Privacy Policy to operate the Service and respond to your request.
7. Acceptable use
You must not:
- interfere with, probe or attempt to bypass Service security;
- submit unlawful, deceptive, abusive or malicious material;
- use automated access that burdens the Service or source systems;
- resell or misrepresent reports as certified professional work;
- use the Service to violate privacy, intellectual-property or other laws.
8. Intellectual property and public data
The Service’s software, design, branding, analysis and original content belong to WellEstimate or its licensors. Government and third-party source data remain subject to their own terms and licences. These terms do not give us ownership of public records or give you rights beyond those granted by the applicable source.
9. Third-party services and links
The Service relies on and may link to third-party data, geocoding, mapping, email, hosting and contractor services. We do not control their availability, accuracy, security or terms and are not responsible for their independent acts or omissions.
10. Service availability
We may modify, suspend, restrict or discontinue any part of the Service. We do not guarantee uninterrupted operation, preservation of a report URL or continued availability of any dataset.
11. Disclaimer of warranties
To the maximum extent permitted by law, the Service is provided “as is” and “as available,” without warranties of accuracy, completeness, fitness for a particular purpose, merchantability, non-infringement or results. Nothing in these terms excludes a warranty or consumer right that cannot legally be excluded.
12. Limitation of liability
To the maximum extent permitted by law, WellEstimate and its owners, personnel and service providers will not be liable for indirect, incidental, special, consequential or punitive damages, lost profits, lost data, property damage, drilling outcomes, water quality issues or decisions made using the Service.
Our aggregate liability arising from the Service will not exceed the greater of the amount you paid us for the Service during the prior twelve months or CAD $100. This limitation does not apply where prohibited by law.
13. Indemnity
To the extent permitted by law, you agree to indemnify WellEstimate against claims and reasonable costs arising from your unlawful use of the Service, your submissions or your violation of these terms or another person’s rights.
14. Governing law
These terms are governed by the laws of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Courts located in Ontario will have jurisdiction, subject to any mandatory consumer rights that apply to you.
15. Changes and contact
We may update these terms by posting a revised effective date. Continued use after an update means you accept the revised terms. Questions can be sent through our contact page.
